Apogee offers and agrees to the the following services and conditions:

• Apogee offers network related services for a fee as described on the Apogee Service Pricing Guide.

• Apogee offers those services in the context of commonly used terminology in the internet community.

• Apogee offers no further services.

• Apogee provides best effort availability for those services.

• Apogee offers no guarantee or warranty beyond pro rated rebate or credit in return for unavailable service.

• Apogee considers this agreement in effect until one of the following:

  • Formal notification by one party to the other that the agreement is terminated;
  • Failure of fee payment beyond a reasonable time;
  • Failure of Apogee to provide reasonable service;
  • Court order or other similar externally imposed termination.

• Apogee expects agreed fees to be paid in a reasonable timeframe.
